Section 1. Operation on Township Roads

Persons shall operate a snowmobile or all-terrain vehicle (ATV) to the far right side, shoulder, or inner slope of the ditch with the traffic on a Township Road that is plowed, maintained, and named in Canosia Township.

Section 2. Operation on Township Property

No person shall operate a snowmobile or ATV in the Canosia Recreation Facility, on Town Hall and Fire Hall property, on school property, or in the Canosia Cemetery. Permits may be granted to facilitate snowmobile and ATV training classes.

Section 3. Where you may ride:

1. In the bottom or outside slope of a ditch or on the far right side of Township roads in the same direction as highway traffic.

2. In the same direction as highway traffic in the ditch from one half-hour after sunset to one half-hour before sunrise, other than this time you can ride in either direction.

3. On state and local trails.

4. On ice-covered water that you have legal access to.

5. On your own land.

6. On land other than your own, with written permission of the landowner, occupant, or lessee.

Section 4. When making a direct crossing of a street or roadway you must:

1. Bring the snowmobile or ATV to a complete stop before crossing.

2. Yield to all on-coming traffic.

3. Have both front and rear lights on when crossing Township Roads.

4. Cross at a 90-degree angle with respect to the road.

Section 5. Personal Operation of Snowmobiles and ATV’s

No person shall operate his/her snowmobile or ATV in a careless, reckless, or heedless manner, which endangers other persons or their property.

Section 6. Youthful Operation of Snowmobiles and ATV’s

SNOWMOBILES

1. No person under the age of 13 may drive snowmobiles across Township Roads.

2. No person under the age of 13 may drive snowmobiles on Township Roads.

3. Persons ages 14-17 may not drive snowmobiles across or on Township Roads unless in possession of a snowmobile safety certificate or valid driver’s license.

4. Persons age 18 and over may drive snowmobiles and as adults.

5. It is unlawful for the owner of a snowmobile to permit the snowmobile to be operated contrary to the provisions of this section.

1. Persons under the age of 12 may operate only on private property with permission of the owner.

2. For persons ages 12-16 all-terrain vehicle safety certificates are valid only for engine sizes 90cc or less.

3. Persons ages 12-16 may operate an ATV 90cc or less on public lands and waters with safety certificate and under supervision. *

4. Persons ages 12-16 may make a direct crossing of highway with safety certificate and while under supervision. *

5. Persons ages 12-16 must wear a helmet while operating on public lands, waters and on road rights-of-way.

6. Persons ages 16-18 may operate an ATV on public lands and waters without a safety certificate.

7. Persons ages 16-18 must have a driver’s license to make direct crossing of highway, or operate on road rights-of-way.

8. Persons ages 16-18 must wear a helmet while operating on public lands, waters and on road rights-of-way.

*"Supervision" means the person’s parent, legal guardian, or other person 18 years of age or older who holds a valid driver’s license.

Section 7. Speed Limits

No person shall operate a snowmobile or ATV on any Township road at a speed in excess of 25 miles per hour.

Section 8. Lights

No person shall operate a snowmobile or ATV on any Township road unless at the time of such operation the headlamp of such snowmobile or ATV is on.

Section 9. Owner’s Responsibility

A person registered as owner of a snowmobile or ATV may be fined not to exceed $300 if a snowmobile or ATV bearing his registration number is operated contrary to the provisions of this ordinance. The registered owner may not be so fined if:

1. The snowmobile or ATV was reported as stolen to the Canosia Police Department at the time of the alleged unlawful act; or if

2. The registered owner demonstrates that the snowmobile or ATV either was stolen or was not in use at the time of the alleged unlawful act; or if

3. The registered owner furnishes to law enforcement officers, upon request, the identity of the person in actual physical control of the snowmobile or ATV at the time of such violation.

The provisions of this Section do not apply to any person who rents or leases a snowmobile or ATV, if such person keeps a record of the name and address of the person or persons renting or leasing such snowmobiles or ATV’s, the registration number thereof, the departure date and time, and the expected time of return thereof. Such record shall be preserved for at least six months, and shall be prima facie evidence that the person named therein was the operator thereof at the time it was operated contrary to the provisions of this ordinance. The provisions of this section do not prohibit or limit the prosecution of a snowmobile or ATV operator for violating any of the provisions of this ordinance.

Section 10. Penalties

Any person who shall violate any provision of this ordinance shall be guilty of a misdemeanor.
